Tennessee Walking Horse Breeders' & Exhibitors' Association members Fran Cole, Kristin Herman, Julia Tarnawski and Jackie Barton had their motion seeking a temporary restraining order denied by a California judge.  The plaintiffs failed to meet the requirements seeking the restraining order and thus the February 3, 2014 special meeting in Lewisburg, Tenn. will move forward.

The California members had successfully gotten 20% of the members in California to sign a petition seeking the special meeting to remove Christy Lantis as a director from California.  Upon finding out the meeting would be held as the Association headquarters Cole and the other three plaintiffs filed suit against TWHBEA under the Americans with Disabilities Act among other things seeking the vote by mail ballot.

Since filing the suit, Cole has had her member privileges suspended for an unrelated matter.  Cole has refused to cooperate in a TWHBEA investigation of the unauthorized poll conducted by Pat Stout.
