Fifth Circuit Reverses District Court On Mandatory Penalties



The Fifth Circuit Court of Appeals disagreed with the district court in Texas relative to the mandatory penalties. The Fifth Circuit found that the mandatory penalty regulation is not a valid application of USDA regulatory authority  and accordingly reversed and vacated the judgment. Finally, they remanded the case for entry of judgment in favor of Contender Farms and Mike McGartland.
