Judge Lee Russell today denied the petition by Toby
Scarbrough for a Temporary Restraining Order in his
hearing in front of the National Horse Show
Commission. 

Lawyers for Scarbrough and the NHSC will meet tomorrow
morning at 10:00 AM to set the parameters for the
hearing in front of the Independent Hearing Committee
appealing Scarbrough's penalty levied by the
Commission's Lonnie Messick.

The NHSC suspended Scarbrough for 10 years for an
alleged violation of NHSC rules during the 1997
Celebration.  In addition, Scarbrough was reportedly
fined $5,000 and is prohibited from getting a judges
license or serving on any NHSC committees.

Scarbrough has continued to show and participate in
industry functions despite Messick's finding's since
that is allowed under current Commission rules.
